TERMS OF USE, DISCLAIMER & INTELLECTUAL PROPERTY NOTICE

Welcome to the LVD Digital Enchantment Journey, created and operated by LaVooDoo Inc., an Alberta, Canada corporation (“LaVooDoo,” “LVD,” “we,” “us,” or “our”).

The LVD Digital Enchantment Journey is a symbolic, creative mindfulness experience designed to encourage relaxation, self-reflection, personal intention and emotional awareness through storytelling, guided breathing, visualization, artistic expression and symbolic ritual.

Please read these Terms carefully before purchasing, accessing or participating in the LVD Digital Enchantment Journey.

By purchasing access, entering an access code, selecting “I Agree,” or otherwise accessing or participating in the experience, you acknowledge that you have read, understood and agreed to these Terms. If you do not agree, please do not access or participate in the experience.

1. Nature of the experience

The LVD Digital Enchantment Journey is provided solely for:

entertainment;
personal inspiration;
mindfulness;
relaxation;
self-reflection;
creative expression; and
personal intention-setting.

The digital dolls, Enchantment Cards, affirmations, breathing exercises, meditations, visualizations, symbolic energy practices, binding imagery, cleansing rituals and other elements of the experience are creative and symbolic experiences only.

The LVD Digital Enchantment Journey is not medical treatment, mental-health treatment, psychotherapy or professional healthcare. Nothing within the experience should be interpreted as medical, psychological, psychiatric, therapeutic, legal, financial or other professional advice.

LaVooDoo Inc. does not diagnose, treat, cure, prevent or manage medical, psychological, psychiatric, emotional or physical conditions.

2. Symbolic nature of LVD

The dolls, Enchantments, rituals, binding imagery, light, salt, incense, crystals, affirmations, visualization, energy language and other symbolic elements appearing throughout the LVD Digital Enchantment Journey are artistic representations intended to encourage personal reflection and intention.

References to:

shifting energy;
binding energy;
cleansing energy;
releasing energy;
transformation;
protection;
light;
renewal; or
similar concepts

are symbolic and metaphorical in nature.

LaVooDoo Inc. does not represent or guarantee that any doll, Enchantment, ritual, object or activity possesses supernatural powers, produces measurable energetic effects, predicts future events, influences another individual, or guarantees any particular personal outcome.

The LVD concept is about binding negative energy, not people.

3. No guarantee of results

Every individual's experience is personal and different. LaVooDoo Inc. makes no promise, representation or guarantee regarding any particular result from participating in the LVD Digital Enchantment Journey.

No guarantee is made regarding:

healing;
emotional improvement;
physical or mental health;
relationships;
personal transformation;
happiness;
financial success;
spiritual outcomes;
future events;
changes in circumstances; or
any other personal result.

Any meaning, insight or interpretation you take from the experience is personal to you.

4. Personal responsibility

By participating, you acknowledge and agree that:

your participation is voluntary;
you remain responsible for your own choices, decisions and actions;
you are responsible for determining whether participation is appropriate for you;
personal interpretations of the experience are your own;
you may stop participating at any time; and
you should seek appropriate professional assistance whenever circumstances require it.

The LVD Digital Enchantment Journey is intended to complement moments of personal reflection and is not a replacement for appropriate professional care.

5. Health & emotional wellbeing

Some portions of the experience involve breathing, meditation, visualization and personal reflection.

Stop participating if you experience dizziness, shortness of breath, panic, anxiety, emotional distress, physical discomfort or any other adverse reaction.

Breathing and meditation exercises should be performed only while you are in a safe environment. Do not participate while:

driving;
cycling;
operating machinery;
swimming;
performing activities requiring your full attention; or
participating in any situation in which distraction could create a safety risk.

Do not intentionally hyperventilate, excessively hold your breath or continue any breathing exercise that causes discomfort.

If you have concerns regarding whether breathing, meditation or visualization exercises are appropriate for you, consult an appropriate qualified healthcare professional before participating.

6. Mental health & emergencies

The LVD Digital Enchantment Journey does not provide crisis intervention or emergency services.

If you are experiencing severe emotional distress, suicidal thoughts, a mental-health crisis, a medical emergency or believe that you or another person may be in immediate danger, discontinue the experience and contact qualified healthcare professionals or the appropriate emergency services available in your location.

Do not rely upon the LVD Digital Enchantment Journey in place of professional medical or mental-health assistance.

7. Optional physical rituals & fire safety

The Digital Enchantment Journey may depict or reference symbolic items such as incense, candles, matches, salt, crystals or similar objects.

You are not required to physically use these objects in order to participate in the Digital Enchantment Journey.

If you voluntarily choose to use physical objects while participating, you are responsible for doing so safely. Always follow manufacturer instructions and ordinary safety precautions. Never leave candles, matches, incense, open flames or burning materials unattended.

Keep burning materials away from:

children;
pets;
flammable materials;
clothing;
curtains;
furniture; and
other combustible objects or surfaces.

Individuals with respiratory sensitivities, allergies or other relevant concerns should avoid smoke, incense or scented products where appropriate.

LaVooDoo Inc. is not responsible for unsafe or unintended use of physical objects by participants, subject always to liability that cannot lawfully be excluded.

8. Age requirements

The LVD Digital Enchantment Journey is primarily intended for adults.

You must be the age of majority in your jurisdiction to independently purchase and participate in the experience.

Where permitted by applicable law, an individual under the age of majority may participate only with the knowledge, permission and appropriate supervision of a parent or legal guardian.

Parents and legal guardians are responsible for determining whether the experience is appropriate for a minor in their care.

9. Personal digital access licence

Purchasing the LVD Digital Enchantment Journey does not transfer ownership of any LaVooDoo intellectual property to you.

Your purchase grants you a limited, personal, non-exclusive, non-transferable and non-sublicensable licence to access the purchased Digital Enchantment Journey for your own private, non-commercial use, subject to these Terms.

Except where expressly stated otherwise by LaVooDoo Inc., your access code is intended for the authorized user and may not be:

sold;
resold;
publicly posted;
duplicated;
commercially distributed;
exchanged for compensation; or
used to provide unauthorized access to others.

Promotional codes expressly described by LaVooDoo Inc. as shareable may be shared according to the conditions accompanying that promotion.

10. Copyright & intellectual property

The LVD Digital Enchantment Journey and its original content are owned by, or used under licence by, LaVooDoo Inc.

This includes, where applicable:

LVD dolls and original doll imagery;
doll designs;
photographs;
artwork;
animations;
videos;
Enchantment Cards;
Enchantment wording;
affirmations;
written rituals;
scripts;
narration;
meditation content;
audio;
music owned or appropriately licensed by LaVooDoo Inc.;
graphics;
illustrations;
visual effects;
symbolic sequences;
website content;
interface designs;
storyboards;
marketing materials;
logos;
brand elements;
original written content; and
other proprietary creative materials.

These materials may be protected by copyright, trademark and other intellectual-property laws in Canada and other jurisdictions.

No ownership rights are transferred to you through your purchase or participation.

11. No recording, screen capture or reposting

The LVD Digital Enchantment Journey is a private, proprietary digital experience.

Except where expressly authorized in writing by LaVooDoo Inc., you may not:

screen-record the experience;
video-record the experience;
photograph the experience for reproduction or distribution;
systematically screenshot the experience;
download protected content;
copy the experience;
reproduce its content;
extract its content;
redistribute its content;
publicly display its content;
upload its content;
stream or broadcast the experience;
transmit substantial portions of the experience to others;
publish its content;
repost its content on social media;
sell or sublicense its content;
modify its content;
create unauthorized derivative works from its content; or
otherwise commercially exploit the experience.

This prohibition includes unauthorized reproduction or distribution through platforms including social media, video-sharing platforms, websites, applications, messaging platforms and other digital services.

12. Social media

We welcome participants sharing their personal thoughts, opinions and experiences regarding LVD.

You may discuss your experience, recommend LVD to others and share lawful reviews.

However, sharing your personal experience does not grant permission to reproduce or distribute LaVooDoo Inc.'s proprietary content.

Unless LaVooDoo Inc. expressly authorizes otherwise, do not post substantial portions of:

Digital Enchantment Journey videos;
animations;
Enchantment Cards;
complete Enchantment wording;
meditation recordings;
ritual sequences;
proprietary artwork;
protected screen content; or
other copyrighted LVD materials.

You may link others to LaVooDoo Inc.'s official publicly available content.

Nothing in these Terms is intended to restrict any review, commentary or other activity that cannot lawfully be restricted.

13. Artificial intelligence & dataset use

Unless LaVooDoo Inc. provides prior written permission, LVD proprietary content may not be copied, uploaded, supplied or otherwise used for the purpose of:

training artificial-intelligence systems;
training generative-AI models;
creating datasets;
machine learning;
image-generation training;
fine-tuning AI systems;
creating substantially similar dolls, imagery, animations or experiences using AI;
reproducing LVD artwork through generative technology; or
developing competing commercial products or services through unauthorized reproduction of protected LVD content.

This restriction applies to the extent permitted by applicable law and does not purport to prohibit lawful uses that cannot contractually be restricted.

14. No commercial copying or competing use

You may not use protected LVD content to manufacture, market or sell unauthorized copies or adaptations of LaVooDoo Inc.'s products or protected creative materials.

You may not commercially exploit copied LVD artwork, Enchantment Cards, photographs, animations, written Enchantments, videos, graphics or other protected materials without prior written authorization.

Nothing in these Terms grants you a licence to use the names LaVooDoo, LVD, associated logos or other LaVooDoo branding in a manner that suggests sponsorship, affiliation, authorization or endorsement by LaVooDoo Inc.

15. Unauthorized use

Unauthorized access, reproduction or distribution of LaVooDoo Inc.'s proprietary content may result in:

suspension or termination of digital access;
cancellation of access credentials;
removal requests or platform infringement notices where appropriate; and
pursuit of any other rights or remedies available to LaVooDoo Inc. under applicable law.

LaVooDoo Inc. reserves all intellectual-property rights not expressly granted under these Terms.

16. Technical availability

The Digital Enchantment Journey is delivered using digital technology and third-party infrastructure.

Although LaVooDoo Inc. will make reasonable efforts to provide a reliable experience, we do not guarantee that the service will always be:

uninterrupted;
completely error-free;
available on every device;
compatible with every operating system or browser; or
free from temporary technical interruptions.

Maintenance, updates, internet connectivity, device limitations or third-party service interruptions may occasionally affect access.

Nothing in this section limits rights or remedies that cannot lawfully be excluded.

17. User equipment & internet access

You are responsible for obtaining and maintaining compatible equipment, software and internet access necessary to participate in the Digital Enchantment Journey.

Internet, mobile-data and other third-party charges are your responsibility.

18. Limitation of liability

To the fullest extent permitted by applicable law, LaVooDoo Inc. and its directors, officers, employees, contractors, agents, affiliates, licensors and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from or relating to:

participation in the Digital Enchantment Journey;
personal interpretations of the experience;
voluntary decisions or actions taken following participation;
unauthorized or unintended use of the content;
temporary technical interruptions;
device or internet incompatibility; or
reliance upon content that is expressly presented as symbolic, creative or reflective.

Participation in optional mindfulness, breathing, visualization and symbolic activities is voluntary.

Nothing in these Terms excludes, restricts or limits any liability, warranty, consumer right, statutory protection or remedy that cannot lawfully be excluded, restricted or limited.

19. Third-party services & content

The Digital Enchantment Journey may use or link to third-party platforms, software, payment processors, hosting providers, music, content or services.

Where third-party content is used under licence, ownership remains with the applicable rights holder.

LaVooDoo Inc. does not claim ownership of third-party intellectual property.

Third-party services may also be governed by their own terms and privacy policies.

20. Privacy

Personal information collected through the Digital Enchantment Journey will be handled in accordance with LaVooDoo Inc.'s Privacy Policy and applicable privacy laws.

The Privacy Policy should be reviewed separately before using the service.

LaVooDoo Inc. does not sell ownership of user-submitted personal information through participation in the Digital Enchantment Journey.

21. Purchases, refunds & digital delivery

Prices, applicable taxes, currency, payment terms and any additional charges will be disclosed during the purchasing process.

Any refund, cancellation or exchange policy applicable to the Digital Enchantment Journey will be disclosed before purchase.

Because consumer rights vary between jurisdictions, nothing in LaVooDoo Inc.'s refund or cancellation policy eliminates any mandatory cancellation, refund or consumer rights provided by applicable law.

Digital access will be delivered according to the terms presented at the time of purchase.

22. International access

The LVD Digital Enchantment Journey may be accessible from locations outside Canada.

LaVooDoo Inc. operates from Alberta, Canada.

Users accessing the experience from another province, territory, state or country are responsible for complying with applicable local laws.

The availability of the Digital Enchantment Journey in a particular location does not constitute a representation that every feature or aspect of the service is lawful or appropriate in every jurisdiction.

Where mandatory local consumer, privacy or other laws provide rights that cannot lawfully be waived or limited by contract, those mandatory rights remain unaffected.

23. Governing law

Subject to any mandatory laws that apply to you and cannot lawfully be excluded, these Terms and your use of the LVD Digital Enchantment Journey are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Subject to mandatory rights concerning jurisdiction or venue that may apply under applicable law, disputes relating to these Terms or the Digital Enchantment Journey shall be brought before a court of competent jurisdiction in Alberta, Canada.

Nothing in this provision deprives a consumer of protections or rights that cannot legally be waived under the laws applicable to that consumer.

24. Changes to these Terms

LaVooDoo Inc. may update these Terms from time to time to reflect changes in the Digital Enchantment Journey, applicable laws or business practices.

The current version will display its effective or last-updated date.

Material changes will apply prospectively where required by applicable law.

Nothing in this provision authorizes LaVooDoo Inc. to remove or alter consumer rights contrary to applicable law.

25. Severability

If any provision of these Terms is determined to be invalid, illegal or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where legally permitted, and the remaining provisions will continue in effect.

26. Entire agreement

These Terms, together with any applicable purchase terms, Privacy Policy, refund policy and other policies expressly incorporated by reference, constitute the agreement governing access to and use of the LVD Digital Enchantment Journey.

27. User acknowledgement & acceptance

Before beginning the Digital Enchantment Journey, you will be asked to confirm:

I have read and agree to the LVD Digital Enchantment Journey Terms of Use.
I understand that the experience is symbolic and intended for entertainment, mindfulness, personal inspiration and self-reflection, and is not medical or mental-health treatment.
I understand that LVD content is protected intellectual property and that recording, screen-recording, copying, downloading or reposting protected portions of the Digital Enchantment Journey is not permitted except where authorized by LaVooDoo Inc. or permitted by applicable law.
I confirm that I meet the applicable age requirements to participate.

Private digital experience

Please experience this moment rather than record it.

The LVD Digital Enchantment Journey contains proprietary creative content belonging to or licensed by LaVooDoo Inc.

No unauthorized screen recording, copying, downloading or reposting.

You are welcome to share your personal experience and tell others about your journey while respecting the artwork, Enchantments and creative materials that make LVD unique.
